This Privacy Policy applies to the Moodify AI mobile application (the "App" or "Application") and related services (collectively, the "Services"), provided by Codersnap LLC ("Codersnap," "we," "us," or "our"). The Services are offered globally and are provided "AS IS."

This Privacy Policy explains what information we collect, how we use it, how we share it, and the choices and rights you may have. By accessing or using the Services, you agree to this Privacy Policy. If you do not agree, do not use the Services.

• Device-first. Moodify AI is designed to be device-only for storage: your original photos and generated results are stored on your device.
• No training. We do not use your content to train general-purpose AI models.
• Facial processing. To preserve facial realism, we process facial data from photos you choose to use. This may involve biometric information. If you do not consent, the core features will not work.
• No ads / no IDFA. We do not show third-party ads and we do not use the advertising identifier (IDFA/Advertising ID).
• Analytics & crash logs. We use Mixpanel, RevenueCat, and Firebase Crashlytics to understand usage, manage subscriptions, and improve reliability.
• Age. The Services are intended for users 16+.
• Minors in photos. If you upload images containing minors, you must be the parent/legal guardian or have their permission.

We collect information in the following categories:

When you choose photos to use in the App, the App processes those photos to generate results you request (e.g., changing scene/outfit while keeping the face realistic). Generated results are stored on your device. You can export results from the App.

Important note about processing: while storage is device-only, some processing may occur using a hybrid approach (partly on device and partly on servers) to deliver the Services. In those cases, your content may be transmitted for processing and then deleted promptly as described in Section 6 (Data Retention). We do not keep a server-side "library" of your photos or generated images.

AI Models: For image generation, we use Google Gemini models via fal.ai. For video generation, we use Kling AI models via fal.ai. Your content may be processed through these third-party AI providers as part of generating your requested results.

To provide identity-preserving results, the Services process facial data from photos you select. This processing may include biometric information (for example, mathematical representations of facial features used to distinguish a face within an image).

We do not use your facial data to identify you as a person in the real world, and we do not provide a facial recognition or biometric identification service to third parties.

When you download and use the App, we may collect:

• IP address (and general region inferred from IP);
• Device and operating system information;
• App interaction events (e.g., screens viewed, button taps, feature usage);
• Performance and reliability data (including crash reports);
• Approximate timestamps and session duration.

We do not collect precise location data (GPS-level).

If you purchase a subscription or top-up credits, the transaction is processed by the relevant app store or payment platform. We receive subscription status and purchase metadata (e.g., whether a subscription is active). We do not receive your full payment card details.

If you contact support or sign up for communications, we may process your email address and message content. We may also send:

• Service messages (e.g., "image ready," service updates);
• Marketing messages (where permitted by law), which you can opt out of (see Section 9).

We use information to:

• Provide the Services and generate the results you request;
• Process facial data to preserve facial realism and improve output quality for your generation;
• Maintain, secure, and improve the Services (debugging, preventing abuse, reliability);
• Measure performance and understand usage (analytics);
• Manage subscriptions, credit balances, and related billing status;
• Communicate with you about the Services, including required notices.

Depending on your location, we rely on one or more of the following legal bases:

• Performance of a contract: to provide the Services you request.
• Consent: for certain processing (including explicit consent for biometric processing where required).
• Legitimate interests: to secure, maintain, and improve the Services, where not overridden by your rights.
• Legal obligations: to comply with applicable laws and lawful requests.

Moodify AI's core functionality requires processing facial data from your photos to preserve facial realism and generate the results you request. By tapping "Continue" (or similar) and using the relevant features, you provide explicit consent to this processing, which may include biometric information.

If you do not provide (or withdraw) consent for required facial/biometric processing, the identity-preserving generation features will not be accessible.

We are designed not to store your original photos or your generated results on our servers as a persistent library. Your content is stored on your device.

Because some processing may be performed using a hybrid approach, your content may be transmitted to servers for processing. In those cases:

• We process your content to generate the requested result; and
• We delete the content from our servers promptly after processing, and in any event do not keep it as a persistent library.

You can delete content in the App. When you delete, the content is deleted from your device and, if any server-side copies exist for processing or delivery, they are deleted from our servers as well—immediately.

We retain logs and diagnostics for a limited period necessary for security and reliability, then delete or aggregate them.

We do not sell your personal information.

We may share limited information with:

• Mixpanel (product analytics)
• RevenueCat (subscription management)
• Firebase Crashlytics (crash reporting)
• fal.ai (AI model infrastructure for image and video generation using Google Gemini and Kling AI models)
• Service providers who help us operate and secure the Services (for example, infrastructure providers).

We may also disclose information:

• To comply with law, court orders, subpoenas, or lawful government requests;
• To protect rights, safety, and security, investigate fraud or abuse, and enforce our policies;
• In connection with a business transaction (e.g., merger or acquisition), subject to appropriate protections;
• In aggregated or de-identified form.

The Services are intended for users aged 16 and older.

If you upload images containing minors, you represent and warrant that you are the minor's parent or legal guardian, or that you have the parent/legal guardian's explicit permission to upload the image and consent to processing of the minor's facial data (which may include biometric information) as described in this Privacy Policy.

If you believe a minor's data was provided without proper authorization, contact us at [email protected].

Depending on your location, you may have rights to access, correct, delete, or receive a copy of your personal data, and to object or restrict certain processing.

Marketing opt-out: You may opt out of marketing emails at any time by using the unsubscribe link (if provided) or by emailing us at [email protected]. Service/transactional messages (e.g., "image ready," security notices) may still be sent when necessary.

Withdrawal of consent: Where we rely on consent (including biometric processing where required), you may withdraw consent. If the processing is required for core features, those features will not work without consent.

Moodify AI is offered globally. Your information may be processed in countries other than your own. Where required, we use appropriate safeguards for cross-border transfers.

We use administrative, technical, and organizational safeguards designed to protect information. No system is perfectly secure, and we cannot guarantee absolute security.

We may update this Privacy Policy from time to time. We will post the updated version and change the "Last Updated" date. Continued use after changes means you accept the updated policy to the extent permitted by law.
